The following terms and conditions will be applicable in case anyone gets the services offered by Miraj Prime Properites Broker (mirajprimeproperties.com) 

The terms and conditions involve “Miraj Prime Properties” herein referred to as “the company” and individuals, customers, clients, group of customers, companies, private entities, public entities, and any other entity acquiring the services offered at this website herein referred to as “the users”.

“Services” of the company relate to the website platform provided to the “sellers” and “buyers” of real estate properties, which can be listed on relevant forums on the website. 

“Materials /Information” refers to the content provided by sellers of the real estate properties on the website for creating their listing.

“Intellectual property rights of the company” refer to all the registered and unregistered designs, databases, trademarks, copyrights, patents, written content, videos, advertisements, and any other material developed for the purpose this website or any other marketing campaign. The company will retain complete rights in this regard and any material cannot be reproduced or reused for the purpose of obtaining personal and commercial gains by anyone without acquiring proper consent. 

Terms and conditions for the users

Users will have to follow the following terms and conditions in order to acquire the services offered by the company:

1. Users should be at least 18 years of age for acquiring the services of the company.  Users under 18 will acquire the permission of parent or guardian for opening an account and obtaining services.
2. Users can open an account on the website for acquiring the services as sellers and buyers of real estate listings. While opening an account on the website, users must provide the correct information in all regards and they will continue to update any information in the case any change takes place at a later stage. 
3. Provision of incorrect data for registration can result in the termination of the account of the user or any other action as deemed appropriate by the company. 
4. The company also reserves the right to remove any material listing by the user on the website without having to provide any reason in this effect. In most cases, such listings would be removed if found breaching the basic rules, regulations, codes, principles, policies, and the general practice of the company as well as the relevant laws of the region as applicable at the time period. 
5. Users will not upload any material that is illegal, false, misleading, offensive, pornographic, insulting, racially motivated, discriminatory, third-party copyrighted, or in abeyance of any rules or laws applicable in the region at the time of the listing.  Uploading such content provides the company with the right to remove it from the website and take any relevant action against the user as applicable under the law or customary general practice.
6. The company will have the right to utilise the data uploaded by customers on the website for different purposes including the advertisement, marketing, distribution, display, modification, further content generation, and so on.
7. The company reserves the right to use the data provided by the user for customising the experience of services provided to them. The company will also reserve the right to utilise the customer data for the purpose of carrying out marketing, however, users will have the right to opt themselves out of marketing campaigns in case they are not interested at a later stage. The company will not disclose the personal data of customers to third parties without prior knowledge in this regard. 
8. The company will have the right to install “cookies” on the web browser or computers of the users for customising the experience based on their activity on the website. 
9. Users will not infringe upon the intellectual property right of the company as highlighted.
10. Users will not use the platform of the company for indulging in any fraudulent or illegal activities that are prohibited by the law of the region. The company will reserve the right to take action against a user who is found to be involved in illegal and fraudulent activities such as scamming and so on. 
11. Users will not indulge in any activity or utilise the platform that will result in jeopardizing the reputation of the company. 
12. Users who acquire services such as selling or renting real estate properties will not be considered as employees of the company even in cases when they have contracts.

Limitation of liability on the company

1. The company will not be liable for any losses (of any kind) incurred by users of the services offered. Users will have the responsibility of acquiring the services while taking all the necessary measures for protecting them against loss. 
2. The company will not be liable in the case inappropriate content is uploaded by users on the website even though the company will take appropriate action after obtaining knowledge of the same in a reasonable amount of time. The liability of uploading inappropriate content will lie with users. 
3. The company will not be liable for the interaction of the service without prior knowledge to the users.
4. The company will make efforts for protecting users from third party security issues, however, the company will not be liable in case any losses occur due to the actions of third parties on the website.

Warranty and indemnity terms and conditions

1. The company is not responsible for providing any guarantee for the information provided by users of the website. It is the responsibility of the users to make a reasonable decision. A warranty or guarantee may apply in the case specified on a particular listing, however, all other listings would be excluded.
2. The company will not have the responsibility of preparing any material or content for meeting the personal requirements of the users.
3. The users provide full indemnity to the company in the case they incur any losses while using the services offered by the company.
4. Any warranty offered to the user as a part of any campaign, specific listing, or a specific project will be considered as a separate or unique incident and will not be considered as a general practice of the company.
